Welcome to FirstVial. These Terms of Service (“Terms”) govern your access to and use of the FirstVial website, member dashboard, protocols, guides, tools, and related content (together, the “Service”). By creating an account, redeeming an access code, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use FirstVial
You must be 21 years of age or older to create an account or access any member content. By using the Service you confirm that you are at least 21.
FirstVial is offered to residents of the United States only. By using the Service you confirm that you are accessing it from within the United States. We do not market or sell the Service to people outside the United States.
2. Research and educational use only
All content on FirstVial is provided strictly for research and educational purposes. The compounds, protocols, dosing references, and guides described on the Service are presented for informational use in a research context.
Nothing on FirstVial is medical advice, and nothing on the Service is intended to diagnose, treat, cure, or prevent any disease or health condition. The compounds discussed are not approved by the U.S. Food and Drug Administration (FDA) for human use, and FirstVial does not sell, supply, or recommend the purchase of any compound. Always consult a qualified, licensed healthcare professional before making any decision related to your health.
3. Personal use, no redistribution
Your account and your access to the Service are personal to you. The content is licensed to you for your own personal research use only. You may not copy, republish, resell, share, sublicense, distribute, or otherwise make the content available to any other person or to the public, whether for free or for payment. You may not share your login credentials or allow anyone else to use your account.
You may download and keep copies of your content library for your own personal records, including through the export tools we provide. The download feature is for your personal use and does not grant you any right to redistribute the content.
4. Memberships and plans
FirstVial offers several ways to access the Service:
- Monthly and Annual plans, which are recurring subscriptions billed in advance.
- Lifetime access, which is a one-time purchase as described below.
- Complimentary access granted to eligible customers through a redemption code.
5. What lifetime access means
Lifetime access means access for the life of the platform. As long as FirstVial continues to operate the Service, your lifetime access remains active with no recurring charge. Lifetime access is tied to the continued operation of FirstVial and does not guarantee that the Service will operate for any fixed number of years.
If FirstVial ever decides to shut down the Service, the commitments in Section 7 apply, including advance notice and continued access to download your full content library.
6. Cancellations and refunds
Monthly and annual members can cancel at any time, no questions asked. You can cancel from your account billing portal. When you cancel, your membership stays active through the end of the period you have already paid for, and it does not renew after that. We do not provide partial refunds for the unused part of a billing period.
Lifetime purchases are final and non-refundable. In exchange, your access to download and export your full content library is always available to you for as long as you have access, so that the value you paid for stays in your hands.
7. If FirstVial shuts down
We intend for FirstVial to be a lasting resource. If we ever decide to wind down or permanently shut down the Service, we commit to the following for every active member, including lifetime members:
- We will give at least 90 days advance notice before the Service closes. We will send this notice to the email address on your account.
- During the entire 90 day notice period, all active members will be able to log in and download their full content library, including every protocol and guide they have access to, using the export tools in the dashboard.
Because content export is always available and remains available throughout the notice period, a shutdown does not entitle you to a refund, including for lifetime purchases.
8. Your account
You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission. We may suspend or terminate accounts that share access, redistribute content, or otherwise violate these Terms.
9. Payments
Payments are processed by Stripe, our third party payment processor. When you pay, your card and billing details are handled by Stripe under their terms and privacy policy. FirstVial does not store your full card number. Recurring plans are billed automatically until you cancel.
10. Intellectual property
The Service and its content, including text, protocols, guides, tools, graphics, and design, are owned by FirstVial or its licensors and are protected by intellectual property laws. Except for the personal use rights described in these Terms, no rights are granted to you.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. FirstVial does not warrant that the content is complete, accurate, current, or suitable for any particular purpose. You use the Service and rely on its content at your own risk. The content is for research and educational purposes only, is not medical advice, and describes compounds that are not approved by the FDA for human use.
12. Limitation of liability
To the fullest extent permitted by law, FirstVial and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of or related to your use of the Service or the content. Our total liability for any claim relating to the Service will not exceed the amount you paid to FirstVial in the 12 months before the claim.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify members by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
